IMPORTANT NOTICE TO ALL GALAXY CUSTOMERS
Dear Galaxy Subscriber:
Galaxy Cable Inc. provides you with this notice under federal law to inform you of your privacy rights as a Galaxy subscriber.
We are proud of our long history of protecting customer privacy, and believe all of our customers should know what information is collected and why. Galaxy collects and maintains a list of all of our customers’ names, addresses, telephone numbers and such information as billing and payment records, service and repair records, premium service subscription information, marketing information, and complaints.
This information is collected, used and disclosed as necessary to conduct any legitimate business activity related to cable, high-speed Internet, and phone service that we may provide to you, including to detect unauthorized reception of cable communications.
Frequency of disclosure may be on a day-to-day basis to our employees, agents, and those providing programming and administrative services to us.
We maintain the information set forth for such time as you are a subscriber to the system and, upon termination of service, for one year after receipt of final payment for all cable or other services rendered.
Within a reasonable length of time following a request for same, any customer may inspect their own personally identifiable information at our local office during regular business hours (preparation is sometimes necessary to avoid disclosure of information relating to other subscribers.) Customers will be provided reasonable opportunity to correct any error in such information.
Federal law also permits our cable company to collect and disclose names and addresses of customers, provided the list contains no personally identifiable information. However, customers have the right to elect not to be included on such a list. If you desire to be excluded from such list of names and addresses, simply notify us in writing of your decision to be excluded.
A governmental entity authorized under chapters 119, 121 or 206 of Title 18 of the United States Code may obtain personally identifiable information concerning a customer, except that any such disclosure to the governmental entity shall not include records revealing the customer’s selection of video programming. A governmental entity may also obtain personally identifiable information pursuant to a court order only if, (i) in the court proceeding relevant to such court order, such entity offers clear and convincing evidence that the subject of the information is reasonably suspected of engaging in criminal activity and that the information sought would be material evidence in the case; and (ii) the subject of the information is afforded the opportunity to appear and contest such entity’s claim. In such case, Galaxy shall disclose the personally identifiable information only after the customer is notified of such order by the person to whom the order is directed.
We reserve the right to collect and disclose information in collective or aggregate formats, such as ratings surveys and other statistical reports, which do not personally identify you .
Under the Cable Communications Act of 1984, violation of these provisions may lead to certain criminal and civil liabilities. A person aggrieved by a violation of these provisions may sue for damages in the appropriate court.
